The short version

  • Privately Known helps you request and arrange cars, yachts, villas and hotel stays, mostly from independent providers in Miami.
  • A request isn’t a booking. A booking is confirmed only in writing, after any required checks, a signed agreement and payment.
  • The provider named in your booking agreement delivers the service, and that agreement controls the booking.
  • Cars: a rental day is 24 hours and includes 100 miles; extra miles are $5 each. Late returns cost $100 an hour after a 30-minute grace period, up to a day’s rate per day. Stay within Miami-Dade, Broward and Palm Beach unless the provider agrees in writing. Car quotes include a 5% concierge service fee (waived for members) and a 24% platform fee on the rental; neither is a tax.
  • Full Owner Membership is $199 a month, with no minimum and no cancellation fee. Paid enrollment isn’t open on the website yet.
  • These terms don’t include forced arbitration, a class-action waiver or a cap on our liability.

01About these terms

These Terms cover the Privately Known website, accounts, membership and the services Esoteric Exotics LLC, doing business as Privately Known (“Privately Known,” “we,” “us”), provides directly. Our address is 2500 NW 39th St, Miami, FL 33142, United States, and our legal and service contact is rd@privatelyknown.com.

Important: the sections on disclaimers, responsibility and third-party claims apply only as far as the law allows. These Terms don’t replace the signed agreement for a particular car, property, charter or activity.

To create an account or request a service you must be at least 18 and able to enter a contract. A supplier may require a higher age or other qualifications. If you act for a business or another adult, you must be authorized to. Please give accurate information and pass the booking requirements on to your group. Sending a group request doesn’t waive anyone else’s rights.

When we ask you to accept these Terms, you agree by taking the acceptance step shown. Simply browsing doesn’t start a paid membership, authorize a charge, confirm a booking or sign an activity release. Our Privacy Policy explains how we handle data. Accepting these Terms isn’t a substitute for any separate consent needed for marketing or sensitive information.

02Our role and the provider’s role

Privately Known presents a collection of cars, yachts, homes, hotels and experiences, handles requests, coordinates the arrangements you ask for, and offers the membership described in an accepted enrollment offer.

Many offerings come from independent businesses. Depending on the booking, these include MVP or another vehicle provider, Jatina or a property manager for a home, the hotel you choose, and add-on providers. For charters, Miami Yacht Concierge and Miami Yachting Company name Miami Yachting Group LLC as the booking business in their current terms, and the owner, contracting party and operator must be named for each vessel. The provider named in your booking agreement is responsible for the service it provides. A listing, an introduction, a shared pickup spot or the words “our collection” don’t by themselves make us the owner, carrier, landlord, vessel operator, insurer or employer of an independent provider.

If Privately Known itself owns, operates or agrees to deliver a service, the booking agreement will say so and set out our responsibilities. These Terms don’t relabel our own service as someone else’s or remove duties the law places on us. A provider’s staff, equipment, standards and on-site decisions are normally its own responsibility, but we stay responsible for our own legal duties and promises. A recommendation isn’t a guarantee of future performance, safety, finances or insurance.

We may earn supplier commissions, referral fees, disclosed planning or service fees, or a margin on an agreed price. Any fee you pay will be shown to you before you agree to it. No supplier or intermediary can commit another party beyond its actual authority.

03Requests, quotes and confirmation

A request, application, proposal, availability display, saved itinerary or automatic acknowledgment is information, not a confirmed reservation. Where online booking is offered, follow the booking steps and keep your confirmation. A request form or an unavailable checkout doesn’t confirm a booking or authorize a charge. You’re welcome to ask us for help, but you never have to use us instead of an available online booking process.

A booking is confirmed only when the responsible party confirms it in writing and you complete the stated conditions, including any eligibility checks, signed agreement and authorized payment. Please don’t make nonrefundable travel plans based on an unconfirmed request.

Availability, prices, images, amenities and itineraries can change before confirmation, and photos are illustrative. If there’s a material error, we’ll explain it before asking you to accept a corrected offer. We won’t change a price after you’ve paid and treat your silence as acceptance. Confirmed bookings stay under their accepted terms and the law.

Please check names, dates, pickup and return times, locations, party size and what’s included, and tell us promptly about any error. This doesn’t remove your legal rights or excuse an error we’re legally responsible for.

04Prices, payments and deposits

Your quote and booking agreement name the supplier, the contracting party, who you pay, the currency, total price, payment schedule, taxes, mandatory charges, optional extras and any security deposit or card hold. A security deposit is different from paying toward the price.

Car rental charges: every car quote shows, as separate lines included in the total price, a concierge service fee of 5% of the rental (not of extras or delivery; waived for renters with an active membership at booking) and a platform fee of 24% of the rental (car preparation, detailing, inspection, staffing and insurance administration). They apply however you pay, so they aren’t card surcharges, and neither is a tax or government charge. Florida’s rental car surcharge of $2 a day and sales tax are shown separately.

We show mandatory charges as the law requires, including total-price rules for short-term lodging. Add-ons you choose, such as catering, water toys, transfers or a private chef, cost extra unless your quote includes them.

Pay only with the method and recipient named in your approved booking. Payments to a supplier follow its disclosed payment terms and the law. We don’t offer escrow or trust protection unless we expressly say so and it’s legally set up.

Charges for damage, extra mileage, fuel, late return, cleaning, tolls, tickets, loss of use or other incidentals must be supported by your accepted agreement and the law. These Terms alone don’t authorize unlimited charges to your card, and you keep your right to dispute a charge in good faith, including any lawful chargeback.

05Changes, cancellations and refunds

Before you commit, check the cancellation deadline and time zone, refundability, no-show rules, change fees, what happens if the supplier cancels, weather rules and any planning fee. Each part of a trip can have different conditions.

Send changes or cancellations through the booking channel we gave you. An unsent draft or a message posted elsewhere isn’t a cancellation. We’ll acknowledge requests we receive. If you don’t hear back, contact us again, and don’t wait if a deadline is close.

Car rentals: if you cancel, we keep the 50% booking payment and refund anything you paid beyond it. If you move your dates at least 72 hours before pickup, you can put the 50% toward one new booking within 12 months instead. Your rental agreement sets out the details.

If we cancel a car booking: we may cancel a confirmed car booking if the car becomes unavailable or unsafe to rent, for example after a mechanical fault, damage or an accident. We’ll offer you a comparable car or a full refund of everything you paid, whichever you choose. We never cancel a confirmed booking to re-rent the car at a higher price.

A supplier’s policy applies only as far as it was properly disclosed and is enforceable. We can’t guarantee a supplier will give a discretionary refund, but we’ll pass on any refund we receive for you, honor any refund we owe ourselves, and never keep money we’re legally required to return.

Weather, government restrictions, closures and mechanical problems can affect a service. Your agreement and the law decide rescheduling, replacement, credit or refund. These events don’t automatically make every payment nonrefundable or excuse our own payment obligations. For yachts, a rain forecast alone may not meet the operator’s cancellation conditions, so get the actual policy before booking.

06Cars and driving

  • Rental day: 24 hours in a row, starting at the pickup time in your rental agreement.
  • Miles: 100 miles included per rental day, for members and non-members, including any free promotional day.
  • Extra miles: $5 per mile over your total allowance, plus any tax shown in your quote, measured from the pickup and return odometer readings and itemized. You can also buy extra miles when you book: 100 miles for $400, 200 for $700 or 300 for $950.
  • Where you can drive: Miami-Dade, Broward and Palm Beach counties, with no permission needed to drive between them. Anywhere else needs written permission from the rental provider first.
  • Young drivers: a young-driver fee applies once per rental for each driver under 25: $299 for drivers aged 21 to 24 and $499 for approved drivers aged 18 to 20.
  • Longer rentals: on rentals of 4 or more days, for members and non-members alike, the first three days are priced as a 3-day rental and each further day costs one third of that 3-day price.
  • Security deposit: a separate hold on your card, set by make as shown on the car’s page, never less than $1,000 ($5,000 for drivers with a license issued outside the United States), and released 1 to 3 days after return, minus any charges under your rental agreement. Renters who buy All-In have half of that hold placed, never less than $1,000; the $5,000 international deposit is not halved.

Miles are pooled across your whole rental. For example, a 3-day rental includes 300 miles, so driving 325 miles costs $125 before tax. Unused miles have no cash value and don’t carry over to a later booking. Signed rental agreements keep the terms you accepted.

A partial day or extension must show exact times, price and included miles in the accepted quote. Returning early doesn’t automatically change a 24-hour rate, and an extension isn’t confirmed until the provider accepts it.

Late return: after a 30-minute grace period, $100 an hour, up to one day’s rental rate for each 24 hours late. Keeping a car more than 24 hours past its return time without a written extension is unauthorized use.

Damage: we charge the exact cost on the repair shop’s invoice, with no markup, plus reasonable towing if needed, or the damage can be handled as a claim on your insurance. We never charge you for the days the car is off the road. We may claim that lost rental income from your insurer, but not if you bought the Loss of Use Waiver. Damage covered by protection you bought (for example the Wheel/Door/Windshield Waiver, which includes tires, or Tire Protection, $99, for tires only) isn’t charged, under that protection’s terms. Your rental agreement sets out the details.

To take a car outside the three counties, you can send the destination and dates to rd@privatelyknown.com and we’ll coordinate, but sending the request isn’t permission. This rule is about where the car can go; it doesn’t create a fee, penalty or automatic loss of insurance. Any extra charge or coverage condition must be disclosed and valid under your agreement and the law.

The rental agreement names the actual provider and sets the rules on authorized drivers, minimum age, license and driving record, insurance or protection, deposits, delivery, fuel, condition, incidents and returns. Confirm the 100-mile allowance and $5 overage in your quote before you accept. Nothing on this website guarantees driver approval or that your own insurance covers a particular car.

Only authorized, licensed drivers may drive. Follow traffic laws and your agreement: no impaired driving, racing, speed contests, reckless driving or unauthorized use. A group drive isn’t a closed course. Report accidents, damage, breakdowns or safety concerns promptly through the provider’s process, and call emergency services when needed. Any vehicle tracking must be disclosed by the provider; these Terms don’t give consent to undisclosed tracking.

07Yachts, water activities and add-ons

A yacht booking follows the agreement for that vessel, including its named contracting parties, passenger limits, boarding times, permitted use, weather rules, crew and safety requirements. Miami Yachting Group LLC is named as a booking business by Miami Yacht Concierge and Miami Yachting Company; that doesn’t mean it owns or operates a particular yacht. Your quote and charter agreement must name the owner or authorized contracting party, who you pay and how the vessel is operated.

Before you pay, the booking documents must show the charter price, mandatory charges, taxes, any required crew payment or gratuity, fuel and dockage terms, deposit, balance deadline, cancellation cutoff (with date, time and time zone), weather remedies and what happens if the supplier cancels. Terms vary by vessel and holiday, so don’t rely on a policy from another yacht or an older page. Any change of payee or material term must be explained and accepted before you pay.

Bareboat and crewed charters are different arrangements, and the actual contracts decide who has possession and control. The qualified captain makes operational safety decisions.

Water toys, catering, alcohol, entertainers, wellness services and other add-ons may come from independent businesses. Each add-on must show its provider, price, payment and deposit, ordering deadline, cancellation terms and any restrictions before purchase. Canceling a charter doesn’t by itself decide refunds for every add-on, and nothing is included unless your quote says so.

Tell the provider about dietary or access needs through the right channel. Food may be prepared in shared kitchens, so no description guarantees an allergen-free environment. Any activity release will be presented separately to each person who needs to accept it. Never pressure crew or vendors to allow an unsafe activity. Nothing here waives passenger rights or liability that maritime or other law doesn’t allow to be limited.

08Homes, hotels, travel planning and concierge

The property’s agreement governs occupancy, guest registration, check-in and check-out, events, noise, pets, deposits, housekeeping and on-site support. Don’t hold an event, exceed occupancy or run a commercial activity unless it’s expressly allowed.

Noemie Marcoux provides advisor-assisted planning for bookings made through Fora. Fora’s booking terms and the hotel’s or property’s terms will be provided for each reservation. These Terms don’t change Fora’s agreements or make Fora a party to every Privately Known service.

Concierge support is available for a qualifying hotel or home booked directly through Noemie via Fora, within the scope agreed for that stay. Membership or a car rental alone doesn’t qualify. You still get normal help with the booking you bought through its booking channel. We don’t promise round-the-clock personal concierge or emergency response unless it’s expressly contracted.

Restaurant requests, upgrades, early arrival, late departure, credits and amenities depend on the property, rate, dates, eligibility and availability. A request isn’t a guarantee. Travel documents, entry requirements and personal insurance are your responsibility, unless we expressly take on a duty or owe one by law. We don’t sell or advise on insurance unless separately authorized to.

09Full Owner Membership

Paid membership enrollment isn’t open on the website yet, and no membership charge is collected through it. Creating an account, applying, receiving staff-granted access or accepting these Terms isn’t consent to a charge or proof of payment.

The advertised offer is $199 per month, with no minimum commitment and no cancellation fee. Temporary, event or rental-related access isn’t Full Owner Membership. Membership doesn’t include car rentals, accommodation, yacht charters, insurance, financing, Noemie’s concierge service or Fora travel service.

A paid membership starts only after you separately agree to the recurring charge and see the price, taxes, billing interval, first and next charge dates, included benefits, and the cancellation and policy versions. It renews monthly on the billing date shown until you cancel. A demonstration status or a trial without accepted conversion terms never authorizes a charge.

Cancel anytime by emailing rd@privatelyknown.com from your account email or by using Privacy and billing requests in your account. Cancellation stops the next renewal from the moment we receive it, and you keep access through the paid period unless you ask to close earlier. There’s no cancellation fee. If a renewal is charged after you cancelled in time, we refund it. We record your cancellation and confirm it, but you don’t need the confirmation for the cancellation to count. We look into any charge made after we received your request.

We don’t normally prorate a month you’ve already paid if you cancel. We fix duplicate or unauthorized charges and give any refund the offer or the law requires. If we permanently stop the membership or end your access without a breach by you, we refund the unused part of your prepaid period. Suspending or deleting an account never leaves membership billing running.

We’ll give at least 30 days’ notice of a price increase and apply it only at a later renewal, with any further consent the law requires. We won’t retroactively reduce a benefit you’ve earned. Savings examples are illustrative, not guaranteed.

10Member rental offers and referrals

Members with an active Full Owner Membership get these rental offers. They don’t combine:

  • 2-day rental: first day full price, second day 50% off.
  • 3-day rental: two days full price, third day free.
  • 4 or more days: the first three days are priced as the 3-day offer, and each further day costs one third of that 3-day price.

Members also don’t pay the 5% concierge service fee on car rentals, and get free delivery and collection on rentals of 3 days or more, including at MIA, FLL and PBI airports. These apply alongside the offers above.

Car and date availability, supplier acceptance and your written quote decide whether a rental qualifies. Membership fees, taxes, deposits, insurance and other disclosed charges are separate, and delivery is charged except as described above. Examples are illustrative; your accepted quote controls.

Referral rewards apply to the $199 monthly membership fee only, not to rentals or other services. The highest tier you reach replaces the lower one; they don’t stack:

Qualifying referralsYour membership fee
110% off ($179.10 a month)
525% off ($149.25 a month)
1050% off ($99.50 a month)
25100% off, membership for life ($0)

A referral counts once the new member’s first monthly payment has cleared and stayed unrefunded for 30 calendar days, and the signup came through your referral link or a verified referral recorded before that payment. Self-referrals, duplicates, fraud, unpaid signups and reversed payments don’t count. A referred member cancelling later doesn’t remove a referral you validly earned. If there’s an attribution error, we’ll tell you and give you a chance to correct it. We apply your highest earned discount at the next renewal after we verify it, and we may fairly investigate fraudulent, duplicate or reversed transactions first. Rewards can’t be shown as applied to a bill until billing is connected.

Membership for life (25 referrals): we waive your standard Full Owner Membership fee for your lifetime while the membership program operates. It’s personal and can’t be transferred. It survives price increases, rebranding and a transfer of the program, and isn’t lost when referred members leave. If you cancel, your earned waiver is kept if you rejoin. Rentals, add-ons and separately priced services are still charged. Any exclusion for proven fraud or serious misconduct is applied fairly and never used to avoid an earned benefit. If the whole service permanently closes, we don’t promise it continues or a cash substitute, but this doesn’t waive legal remedies or obligations already owed. This wording doesn’t narrow any earlier enforceable promise.

Credits or rewards have only the value, use and expiry stated in an accepted offer and allowed by law. An internal ledger or demonstration balance isn’t cash or a promised benefit, and these Terms don’t create any separate upgrade credit.

11Member reports and courses

MMR valuation and CARFAX history requests are handled by our staff, with allowances and availability confirmed before you enroll or request one, and are subject to the report providers’ permissions. Reports may be incomplete or out of date. They aren’t a mechanical inspection, title guarantee, warranty or promise of resale value, so get an independent inspection and professional advice before buying.

Exotic Car Blueprint and our other educational materials are general information, not a promise of earnings, savings, loan approval or investment results, and not individual legal, tax, financial or insurance advice.

12Events and activities

Dates, locations, admission, inclusions and prices are confirmed for each event. A members’ outing linked to Supercar Saturdays is separate from the public show; membership doesn’t mean ownership of, affiliation with or exclusive admission to the show. Cars and optional activities are booked separately.

Driving, boating, swimming, exercise and similar activities carry real risks, including injury, property damage and changing conditions. Know your limits, follow qualified providers’ instructions and don’t take part when it’s unsafe. Any activity-specific release will be presented separately and must be properly accepted. These Terms aren’t a blanket release for injury, death or all provider negligence, and a group organizer can’t waive everyone’s rights.

13Using the website and your account

Keep your sign-in secure and tell us about suspected misuse. Don’t bypass access controls, scrape member or customer information, impersonate others, interfere with the service or use content unlawfully. You may use the site for genuine personal or authorized business requests and the benefits on your account.

You keep ownership of what you send us, and you let us store and use it only as needed to provide the feature, show it to its intended audience, moderate it and comply with law. Using your identity, testimonial or private media in public advertising needs your separate permission. Nothing here stops you from leaving honest reviews, making lawful complaints or contacting regulators. Don’t post someone else’s private information, infringing or unlawful material, fraudulent offers or harassment.

Our branding and original content, and licensed third-party materials, belong to their owners. Except where the law allows, you may not republish, resell or commercially use them. Third-party names and links identify their services and don’t mean endorsement.

14Changes to the service, suspension and ending access

We may change or discontinue website features going forward, or suspend access where reasonably needed for security, fraud, legal requirements or a material breach. Where practical, we’ll give notice and a chance to fix a breach that can be fixed. We won’t use this to avoid a confirmed booking, an earned benefit or a required refund.

Suspension never authorizes charging for a service we no longer provide. If access ends, payment duties already owed, content restrictions, dispute terms and other terms meant to continue still apply.

15Disclaimers

As far as the law allows, the website, general content and information tools are provided “as is” and “as available.” We don’t promise uninterrupted or error-free access, that all third-party information is complete or current, or that a request will lead to a particular booking, benefit or outcome. To the same extent, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement for the website and information tools.

This doesn’t override an express written promise we’ve made about a service you bought, or any guarantee, duty of reasonable care or consumer right the law doesn’t allow us to exclude.

16Our responsibility

Responsibility for a claim is decided by your accepted agreement and the law. These website Terms don’t set a dollar cap on liability or exclude new categories of damages.

Nothing in these Terms limits liability the law doesn’t allow us to limit, including for fraud, willful misconduct, gross negligence, death or personal injury; money or refunds we must return; our actual responsibilities if we are the owner, lessor, carrier or operator; or your non-waivable statutory, privacy, maritime and consumer rights.

We don’t insure an independent supplier’s performance, and we aren’t responsible just because a supplier defaults, makes a mistake or is interrupted. That doesn’t excuse our own breach of a duty to you or override mandatory rules for package travel or other regulated services.

17Third-party claims

Each side stays responsible for third-party claims as far as the law or a separate lawful agreement makes it responsible. These website Terms don’t make you indemnify or reimburse us.

In particular, you don’t have to cover us for our own negligence or misconduct, a supplier’s conduct you didn’t cause, an honest complaint or review, or your use of a consumer right. If a claim involves you, we’ll tell you promptly, let you take a reasonable part in the defense and reasonably limit losses. We won’t settle in a way that makes you admit something, take on an obligation or pay without your consent, which you won’t unreasonably withhold. Responsibility is shared according to fault and the law.

18Disputes and governing law

If something goes wrong, email rd@privatelyknown.com with what happened and what you’d like us to do, so we can try to sort it out. Talking to us first is encouraged, but it doesn’t stop you from seeking urgent relief, complaining to a regulator, using small claims court or filing to protect a legal deadline.

The applicable law and your mandatory venue rights govern a dispute. These Terms don’t pick an exclusive court or a new governing law, and they don’t override protections where you live or applicable maritime law. A supplier’s separately accepted agreement may govern a dispute with that supplier where lawful.

No forced arbitration, no class-action waiver and no jury-trial waiver. Any separate dispute agreement would have to be clearly disclosed and actively accepted by you.

19Changes to these terms and other details

We may update these Terms going forward, showing the new version and date and giving appropriate notice. A material change affecting a paid relationship takes effect only with the notice and consent your agreement and the law require. We won’t retroactively change a confirmed booking or a dispute, cancel an earned lifetime benefit through fine print, or treat silence as agreement to a new recurring charge.

If documents conflict, mandatory law comes first. Your accepted booking or enrollment agreement then controls the matters it covers, and these Terms cover the website and our general services. A supplier’s agreement doesn’t automatically change our own obligations. Our Privacy Policy governs how we handle data and doesn’t waive your privacy rights.

If part of these Terms can’t be enforced, only that part is limited and the rest still applies. Not enforcing a term once doesn’t waive it. If we transfer these Terms, that can’t reduce your consumer rights or what we already owe you. These Terms and any properly accepted extra agreements are the whole agreement on their subject, without excluding liability for legally actionable statements.

These Terms don’t claim any seller-of-travel registration, independent-agent filing or exemption, insurance coverage or legal approval. Our connection with Fora doesn’t by itself mean we are covered by a registration or exemption.
